1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Alethia platform, operated by Alethia Intelligence ("Alethia", "we", "our", or "us"), accessible at alethia-intelligence.ai.
By creating an account, accessing, or using Alethia in any manner, you agree to be bound by these Terms. If you are using Alethia on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, in which case "you" refers to both you individually and the organisation.
If you do not agree to these Terms, you may not use the Alethia platform.
These Terms were last updated on February 8, 2026. Your continued use of Alethia constitutes acceptance of the current version of these Terms.
2. Description of Service
Alethia is an AI-powered marketing infrastructure platform that provides:
- Google Tag Manager Auditing: Automated scanning of GTM containers for configuration issues, missing tracking, and compliance gaps, with AI-generated remediation recommendations
- Cross-Platform Ad Management: Unified management of advertising campaigns across Google Ads, Meta Ads, LinkedIn Ads, and TikTok Ads through official platform APIs
- Privacy & Compliance Monitoring: Automated checking of GDPR, CCPA, and POPIA compliance requirements across your marketing infrastructure
- Intelligence & Analytics: AI-powered analysis, anomaly detection, performance forecasting, and creative analysis
- Safety Approval Chain: A 3-layer human-in-the-loop system for reviewing and approving all changes before execution
- Audit Trail: Comprehensive logging of all actions with rollback capability
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to users.
3. Account Registration & Security
3.1 Account Creation
To use Alethia, you must create an account by providing a valid email address and creating a password. You must provide accurate, complete, and current information during registration and keep this information updated.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Promptly notifying us of any unauthorised access to your account at [email protected]
- Ensuring that all users who access your account comply with these Terms
We are not liable for any loss or damage arising from your failure to maintain account security.
3.3 Eligibility
You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.
3.4 One Account Per Legal Entity
Each legal entity (individual or company) is permitted one account unless otherwise agreed in writing. Agency accounts may manage multiple client sub-accounts under a single agency account with appropriate plan subscription.
4. Acceptable Use Policy
4.1 Permitted Use
You may use Alethia solely for legitimate marketing operations, advertising management, and analytics purposes in accordance with these Terms and all applicable laws.
4.2 Prohibited Activities
You agree not to use Alethia to:
- Violate any applicable laws, regulations, or platform policies (including those of Google, Meta, LinkedIn, and TikTok)
- Engage in deceptive, fraudulent, or misleading advertising practices
- Access or attempt to access other users' accounts or data
- Reverse engineer, decompile, or disassemble any part of the Alethia platform
- Use automated scripts, bots, or scrapers to access the platform beyond permitted API usage
- Resell, sublicense, or provide access to Alethia to third parties without our written consent
- Use Alethia for any unlawful purpose or in any manner that could damage, disable, or impair the service
- Circumvent usage limits, rate limits, or access controls
- Introduce malicious code, viruses, or other harmful content
- Use the platform to manage advertising for illegal products or services, adult content (without appropriate platform clearance), or otherwise prohibited categories
4.3 Platform Compliance
When using Alethia to manage advertising campaigns, you remain responsible for compliance with the terms of service of each connected platform (Google, Meta, LinkedIn, TikTok). Alethia facilitates management but does not guarantee that your campaigns comply with platform policies.
5. Third-Party Integrations
5.1 Platform Connections
Alethia integrates with third-party platforms (Google, Meta, LinkedIn, TikTok) through their official APIs. By connecting a platform account, you:
- Grant Alethia permission to access and manage the resources you authorise during the OAuth flow
- Represent that you have the authority to connect those accounts to Alethia
- Acknowledge that each platform's terms of service continue to apply to your use of that platform
- Accept that Alethia's ability to access platform data may be restricted or revoked by the platform at any time
5.2 Third-Party Services
Alethia uses certain third-party services to operate (e.g., Google Cloud Platform, Supabase, Cloudflare, PayFast). Your use of Alethia is subject to any applicable terms of those underlying services to the extent they apply to you directly. We are not responsible for the availability, performance, or practices of third-party services beyond our control.
5.3 No Endorsement
Our integration with third-party platforms does not constitute an endorsement of those platforms or their practices. We are an independent third-party tool and are not affiliated with, officially endorsed by, or certified by Google, Meta, LinkedIn, or TikTok.
6. Payment & Billing
6.1 Subscription Plans
Alethia offers subscription plans billed monthly or annually. Current plan details, pricing, and features are available on our Pricing page. We reserve the right to change pricing with 30 days' advance notice.
6.2 Trial & Limited Access
We may offer trial or limited access plans at our discretion. The features and duration of any such plans may change at any time with reasonable notice.
6.3 Payment Processing
Payments are processed by PayFast, a PCI-DSS compliant payment processor. We do not store your payment card information. By providing payment information, you agree to PayFast's terms of service and authorise PayFast to charge your payment method on a recurring basis.
6.4 Refund Policy
Subscription fees are generally non-refundable except where required by applicable law. If you believe you were charged incorrectly, please contact us within 30 days at [email protected].
6.5 Taxes
Prices shown exclude VAT, GST, or other applicable taxes. You are responsible for any taxes applicable to your purchase in your jurisdiction.
6.6 Suspension for Non-Payment
We reserve the right to suspend or terminate your account for non-payment after reasonable notice. You remain responsible for all fees accrued prior to suspension.
7. Intellectual Property
7.1 Alethia's IP
The Alethia platform, including its software, algorithms, AI models, user interface, design, documentation, and all content created by Alethia, is owned by Alethia Intelligence and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on Alethia's proprietary content without our written consent.
7.2 Your Data
You retain all rights to your data — including your advertising account data, GTM configurations, and any content you create. By using Alethia, you grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the Alethia service to you. We do not claim ownership of your data.
7.3 Feedback
If you provide feedback, suggestions, or ideas about the Alethia platform, you grant us a royalty-free, perpetual, irrevocable, worldwide licence to use that feedback to improve the service without obligation to you.
8. Data & Privacy
Your use of Alethia is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using Alethia, you acknowledge that you have read and understood the Privacy Policy.
You are responsible for ensuring that your use of Alethia — including the data you share with us and the advertising practices you manage through the platform — complies with applicable data protection laws, including GDPR, CCPA, and POPIA, as they apply to your business and your customers.
9. Disclaimers
9.1 No Warranties
Alethia is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.
9.2 No Guarantee of Results
We do not guarantee specific results from using Alethia. AI recommendations are based on analysis of available data and may not be correct in all circumstances. All recommendations should be reviewed by a qualified professional before implementation. You are solely responsible for the consequences of actions taken based on Alethia's recommendations.
9.3 Platform API Availability
The availability of Alethia's features depends in part on the availability of third-party platform APIs (Google, Meta, LinkedIn, TikTok). We are not responsible for service interruptions caused by changes to or unavailability of these third-party APIs.
9.4 Compliance
Alethia provides compliance checking tools as a reference, not as legal advice. Our compliance checks are based on publicly available platform requirements and regulations at the time of analysis. Laws and platform policies change — you remain responsible for ensuring your practices comply with applicable laws and you should consult qualified legal counsel for specific compliance questions.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Alethia Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of revenue, profits, or data
- Business interruption
- Ad spend losses resulting from changes made through the platform
- Third-party platform penalties, suspensions, or policy violations
- Costs of substitute services
In no event shall our total liability for any claim arising from or related to these Terms or use of the Alethia platform exceed the greater of: (a) the amount you paid for the service in the 12 months preceding the claim, or (b) USD $100.
Some jurisdictions do not allow exclusions or limitations of liability — in such cases, our liability is limited to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Alethia Intelligence, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of or access to Alethia
- Your violation of these Terms
- Your violation of any third-party rights (including platform terms of service)
- Any advertising campaigns or marketing actions you manage through Alethia
- Your violation of any applicable laws or regulations
12. Termination
12.1 Termination by You
You may terminate your account at any time through the Settings page in the Alethia dashboard, or by contacting us at [email protected]. Upon termination, your access will cease and your data will be retained for 30 days before deletion, in accordance with our Privacy Policy.
12.2 Termination by Us
We reserve the right to suspend or terminate your account immediately and without prior notice if:
- You violate these Terms or our Acceptable Use Policy
- Your account is used in connection with illegal activities
- You fail to pay subscription fees after reasonable notice
- We are required to do so by law or a platform partner
- We reasonably determine your use poses a security or compliance risk
12.3 Effect of Termination
Upon termination: (a) your right to use the service ceases immediately; (b) platform connections will be revoked; (c) your data will be retained for 30 days then deleted; (d) provisions that by their nature should survive termination (Disclaimers, Limitation of Liability, Indemnification, Governing Law) will continue in effect.
13. Governing Law & Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.
13.2 Dispute Resolution
In the event of a dispute arising from or relating to these Terms or your use of Alethia, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation fails within 30 days, the dispute shall be submitted to mediation in Cape Town, South Africa, before resorting to litigation.
13.3 Jurisdiction
Any legal action that cannot be resolved through mediation shall be submitted to the exclusive jurisdiction of the courts of the Republic of South Africa, located in Cape Town, Western Cape.
13.4 Consumer Rights
Nothing in these Terms limits statutory rights that cannot be excluded or limited by contract under applicable consumer protection laws in your jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Send email notification to your registered email address
- Display a notice in the Alethia platform
- Update the "Effective Date" at the top of this document
Changes take effect on the date stated in the notice (minimum 14 days' notice for material changes). Your continued use of Alethia after the effective date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using Alethia and may request account deletion before the effective date.
